Terms of Service

These Terms govern your use of the Autonomic platform, including Commerce Studio, available at threezinc.ai (the “Service”), operated by Autonomic (“we”, “our”, “us”). By creating an account, or by using the Service, you agree to them.

The version in force is the one published here when you accept it or when you renew. Where a clause is genuinely ambiguous, it is read in your favour.

If you agree to these Terms on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.

Autonomic is an AI platform for commerce marketing. It audits product listings, researches competitors and reviews, generates creative assets and listing copy, renders product variants, and — where you have connected a marketplace account — publishes listing content you have approved.

Features are added and changed over time. We may modify or discontinue individual features with reasonable notice where doing so would materially reduce what you have paid for.

• You must give accurate account information and keep it current.
• You are responsible for the security of your credentials and for all activity under your account.
• You must be authorised to act for any brand, organisation or seller account you connect.
• Tell us promptly at api@threezinc.ai if you believe your account has been accessed without your permission.

4.1Plans and credits

Paid plans and credit-based usage are billed as described at the point of purchase. Generation consumes credits at the rate shown before you run a job.

4.2Renewal

Subscriptions renew automatically for the same period until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the paid period and you keep access until then.

4.3Price changes

We may change pricing with reasonable advance notice. A change never applies to a period you have already paid for, and you may cancel before it takes effect.

4.4Refunds

Fees are payable in advance and are non-refundable except where the law requires otherwise or where we have failed to provide the Service.

You may not use the Service to:

• create or publish unlawful content, or content that infringes anyone’s intellectual property, publicity or privacy rights;
• generate a third party’s trademark, brand identity, logo or packaging without the right to use it;
• produce content that is deceptive, that makes claims about a product you cannot substantiate, or that misrepresents what a product is or does;
• generate sexual content involving minors, content promoting violence or hatred against a protected group, or content otherwise prohibited by law;
• access accounts, data or marketplace credentials you are not authorised to access;
• resell or sublicense the Service or the underlying models, scrape the platform, or work around rate limits, credit accounting or access controls;
• breach the terms or policies of any connected marketplace.

A breach of this section entitles us to act under section 11 (suspension and termination).

You keep ownership of the product data, brand assets, reference images and other material you upload (“Your Content”). You grant us only the licence needed to process it in order to provide the Service to you.

You confirm that:

• you own Your Content or have sufficient rights to use it as you are using it here;
• your inputs, and the use you make of the outputs, do not infringe anyone’s rights or break the law;
• any product claims you ask the Service to reproduce are accurate and substantiated.

When you connect a marketplace account such as Amazon Seller Central, you authorise us to access it only within the permissions you grant, and only to provide the Service.

• We act on your behalf and only on content you have reviewed and approved. The Service never publishes anything you have not confirmed.
• You remain responsible for the accuracy and legality of the listing content published to your account.
• You may disconnect or revoke access at any time from the marketplace’s own settings; we stop calling that account immediately.
• We comply with the applicable marketplace developer agreements and data policies. What we access, and what we deliberately do not, is set out in the Privacy Policy.

Subject to your payment of applicable fees, you may use the creatives and copy the Service generates for you commercially and without a time limit. We keep ownership of the Service itself — its software, interfaces and the models behind it.

Whether a given output attracts copyright depends on the law where you are and on how much human creative input went into it; purely machine-generated material often attracts none. We make no representation that any specific output is protectable, and we cannot promise that a similar output has not been generated for someone else.

Output from the Service may be inaccurate, incomplete or unsuitable for your purpose. It is a starting point, not a finished decision.

• You are responsible for checking every asset for accuracy, legality and fitness before you publish it anywhere.
• We do not warrant that generated content will be accepted by any marketplace, or that a published listing will perform in any particular way.
• Where the law or a platform requires AI-generated content to be labelled, that obligation falls on you as the publisher.

If you use the Service as a business, you will indemnify us against third-party claims arising from Your Content, from your use of outputs, or from your breach of these Terms — but not against claims caused by our own failure. We will tell you promptly about any such claim, let you take part in the defence, and not settle it without your agreement.

11.1Availability

We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation. Third-party services and marketplace APIs can be unavailable or change without notice, which affects what the Service can do.

11.2Maintenance

Planned maintenance is announced in advance where practical. Urgent security maintenance may happen without notice.

11.3Suspension

We may suspend access where we reasonably suspect a material breach of these Terms, where the law or a marketplace requires it, or to protect the Service or its other users. We keep any suspension proportionate and tell you why.

11.4Termination

You may stop using the Service at any time. Either party may terminate for material breach that is not remedied within a reasonable period. After termination you have a reasonable period to export Your Content, after which it is deleted in line with the Privacy Policy, subject to any records the law requires us to keep.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, for wilful misconduct, or for death or personal injury caused by negligence.

Subject to that, to the maximum extent the law permits we are not liable for indirect, incidental or consequential loss, or for lost profits, revenue, goodwill or data. Our total liability arising from the Service is limited to the amount you paid us in the twelve months before the claim.

Keep your own copies of anything important. Our liability for loss of data is limited to the cost of restoring it from a backup you could reasonably have maintained.

We may name a business customer and show its logo as a reference on our website and marketing material. Tell us at api@threezinc.ai and we will remove it. Named case studies, testimonials, quotes attributed to a person, or reproductions of your creatives always need your separate written agreement first.

14.1Changes to these Terms

We may update these Terms for a valid reason, giving at least 30 days’ notice in the product or by email. If a change materially disadvantages you, you may terminate before it takes effect. Continued use after that date is acceptance.

14.2Governing law

These Terms are governed by the laws of India, and the courts there have jurisdiction — without removing any protection that the mandatory law of your own country of residence gives you.

14.3Severability and assignment

If any provision is found unenforceable, the rest stays in force and the provision is read down to what the law allows. You may not assign these Terms without our consent; we may assign them as part of a reorganisation or sale of the business.
